Town Meeting Minutes – Monday, December 12, 2011

The regular meeting of the Town of Brusly was held this date, December 12, 2011 at the Brusly Town Hall.

Council Member Hebert led the Pledge of Allegiance. A roll call determined the following officials present:
Mayor: Joey Normand
Council Members: Thomas Olinde, Joanne Bourgeois, Landess Hebert,
Shane André, Chris Kershaw
Town Attorney: Thomas Acosta, Jr.

A motion to approve the minutes of the Town’s regular meeting of November 14, 2011, was made by Council Member André and seconded by Council Member Olinde. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed with a unanimous vote.

Planning and Zoning Committee: None
Finance Committee:
Upon Mayor Normand’s recommendation, a motion to approve Liquor Licenses for Back Brusly Grocery, JW Food Mart, Las Palmas, La. Bayou Bistro Restaurant and Road House Restaurant was made by Council Member Kershaw; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comments. Hearing no comments a roll call vote was had with the following results:
Yeas: Kershaw, Olinde, André, Bourgeois, Hebert
Nays: None
Abstaining: None
Absent: None
The motion passed.

Personnel Committee:
Upon Mayor Normand’s recommendation a motion to approve the 2012 Holiday Schedule as presented was made by Council Member Olinde; seconded by Council Member Kershaw. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Police Committee:
After receiving a report and recommendation from Kim Lemoine, a motion to authorize Mayor Normand to sign a contract with InfinEdge Software, in the amount of $8,400.00, for Ticket Software Updates, was made by Council Member André; seconded by Council Member Olinde. Mayor Normand opened the floor for public comments. Hearing no comments a roll call vote was had with the following results:

Hearing and Final Action on Ordinances:
Mayor Normand opened the public hearing for Ordinance #8 of 2011 to amend Chapter 1.8(c)-Governing Authority, Salaries of Elected Officials; Chief of Police. A motion to amend to read as, effective January 1, 2013, the salary of the Chief of Police shall be Forty-One Thousand ($41, 000.00) dollars, per annum, payable bi-weekly, plus a vehicle allowance of Eight Thousand, Four Hundred ($8,400.00) dollars, per annum, payable monthly, was made by Council Member Olinde; seconded by Council Member Kershaw.
A substitute motion to amend the salary of the Chief of Police to Thirty-Seven Thousand, Four Hundred ($37,400) dollars, plus a vehicle allowance of Twelve Thousand ($12,000.00) dollars, was made by Council Member Hebert; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comments. Hearing no comments a roll call vote was had on the substitute motion with the following results:

Following the approval a roll call vote was had on the original motion to include the amended dollar figures with the following results:

Mayor Normand opened the public hearing for Ordinance #9 of 2011 to amend Chapter 1.8(a)-Governing Authority, Salaries of Elected Officials; Mayor. A motion to amend to read as, effective January 1, 2013, the salary of the Mayor shall be Thirty-Seven Thousand Four Hundred ($37, 400.00) dollars, per annum,
payable monthly, plus a vehicle allowance of Twelve Thousand ($12,000.00) dollars, per annum, payable monthly, was made by Council Member Hebert; seconded by Council Member André. Mayor Normand opened the floor for public comments. After some discussion a roll call vote was had with the following results:
Yeas: Hebert, Kershaw, Olinde, André, Bourgeois
Nays: None
Abstaining: None
Absent: None

Mayor Normand opened the public hearing for Ordinance #10 of 2011 to amend Chapter 27.10-General Provisions, Use of Municipal Vehicles, to read as, Municipal vehicles may be used by any Town Official or employee only for conducting official Town Business. No municipal vehicle may be used by any Town employee while on leave. No municipal vehicle shall leave the West Baton Rouge Parish limits nor shall anyone be permitted to use or be a passenger in the vehicle with the following exceptions:
1. Transport of Town officials and/or employees conducting official Town business.
2. Pursuit and/or apprehension of a suspect.
3. Transport of persons in custody to or from the police department or jail.
A motion to approve was made by Council Member Hebert; seconded by Council Member Olinde. Mayor Normand opened the floor to public comment. Hearing no comments a roll call vote with the following results:

Introduction of Ordinances:
Ordinance #___of 2011 – Chapter 4.6.2 – Military Leave, was introduced by Council Member André.
Resolutions and Commendations: None
Fire Department Report:
Fire Chief Alleman gave the Fire Chief’s report for November. There were nine (9) first aid calls inside of Town and twelve (12) outside of Town. There were two (2) fire calls inside the Town and none outside of Town. There were four (4) motor vehicle fires and one (1) trash fire. There were two (2) motor vehicle crash inside of Town and two (2) outside of Town. The total calls for the month were thirty-two (32). The total for the year is three hundred six (306).
Police Department Report:
Report for the month of November was given by Chief Whaley. There were nine (9) wrecks, seven (7) bench warrant arrests, one (1) DWI arrest, one (1) battery, one (1) damage to property, one (1) burglary, three (3) alarms, seven (7) assists to other agencies, one (1) juvenile matter, three (3) traffic arrests and twenty (20) miscellaneous calls. For the month’s total, there were 54 calls, 214 citations and 257 violations.

Mayor’s Report:
Mayor Normand attended a Keep WBR Beautiful Board meeting with Council Member Bourgeois. He stated that Mary Delapasse, Executive Director of Keep WBR Beautiful, received an award for the affiliate’s outstanding work in its three years of operation; the award was presented at the Keep America Beautiful National Convention at the beginning of December. The Mayor attended the Port Maritime Security Operation Center Dedication, a Fire Sales Tax meeting and the Technical Advisory Committee meeting. Mayor Normand reported that the Live Oak West generator seems to be working well. The Mayor also attended the Pipe Fitters Local 198 Christmas Party and a Rotary Meeting.
Remarks of Personal Privilege:
Keep WBR Beautiful received the outstanding affiliate award in the state of Louisiana for the month of November; this was presented by Leigh Harris, Executive Director of Keep Louisiana Beautiful at the December 8th meeting of the WBR Parish Council.
The Town will celebrate Arbor Day 2011 by planting trees in Alexander Park on December 27; this is part of the requirements for being recertified as a “Tree City.”
Mayor Normand expressed his appreciation to the Council Members for the hard work they put in during the evaluation of elected officials salaries.
Announcements:
The Town Hall will be closed Dec. 23 & 26, 2011.
The Planning & Zoning Meeting will be Dec. 28 at 6:30 PM.
The Town Hall will be closed January 2, 2012.
The Town Committee Meeting has been changed from Monday 01/02/12 to Tuesday 01/03/12.
Flag Program Applications are now being accepted at Brusly Town Hall.
A motion was made by Council Member André to adjourn; seconded by Council Member Olinde. The motion passed with a unanimous vote. The meeting adjourned at 7:55 PM.
