The regular meeting of the Town of Brusly was held this date, April 11, 2011 at the Brusly Town Hall. Council Member Bourgeois led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor: Joey Normand
Council Members: Thomas Olinde, Joanne Bourgeois,
Landess Hebert, Shane André, Chris Kershaw
Town Attorney: Thomas Acosta Jr.

A motion to amend the agenda to begin the meeting with agenda item 10.A and take up agenda item 5.B.2 after agenda item 7.B was made by Council Member Bourgeois; second by Council Member Olinde. The floor opened for public comment. Hearing no comment a roll call was had with the following results:

Fire Department Report:
Asst. Fire Chief Hunts gave the Fire Chief’s report for March. There were six (6) first aid calls inside of town and ten (10) outside of Town. There were four (4) motor vehicle crashes inside of town and three (3) outside of town. There was one (1) mutual aid call inside of town and one (1) outside of town. The total calls for the month were twenty-eight (28). The total for the year is eighty-one (81).

A motion to approve the minutes of the Town’s Regular Meeting of March 14, 2011, was made by Council Member Bourgeois and seconded by Council Member André. Hearing no comments from the public the motion passed unanimously.

Planning and Zoning Committee:
Mayor Normand read aloud a variance request made by Kevin Berthelot – 138 Hebert Street, Lot # 11, Hebert Subdivision for a side setback variance on the west side line of property to replace an existing shed with a larger one , recommended by the Planning & Zoning Commission. Hearing no comment from the public a motion to approve was made by Council Member André; seconded by Council Member Olinde. The motion passed unanimously.

Chief Whaley recommended hiring Brett Cavaliere as a Full Time Police Officer at the rate of $13.75 per hour. Hearing no comment from the public a motion to hire was made by Council Member Kershaw; seconded by Council Member André. A roll call vote was had with the following results:

Chief Whaley recommended hiring Clay Bourg III as a Full Time Police Officer at the rate of $13.00 per hour. After brief comments from the public a motion to hire was made by Council Member André; seconded by Council Member Olinde. A roll call vote was had with the following results:

Chief Whaley recommended hiring Ryan Eidson as a Reserve Officer for a minimum of 16 hours per month. Hearing no comment from the public a motion to hire was made by Council Member Olinde; seconded by Council Member Hebert. A roll call vote was had with the following results:

Hearing and Final Action on Ordinances:
Ordinance #1 of 2011 – Chapter 19, Traditional Neighborhood Development was read aloud and opened for Public Hearing by Mayor Normand. After hearing no comments from the public, the Mayor closed the Public Hearing and presented the Ordinance to the Council for consideration. A motion to adopt Ordinance #1 of 2011 as presented with all changes discussed was made by Council Member André; seconded by Council Member Olinde. A roll call vote was had with the following result.

Ordinance #2 of 2011 – To amend Chapter 19 of the Code of Ordinances of the Town of Brusly, State of Louisiana, to incorporate amended zoning district map under Section 19.22 Map, specifically: Re-zoning and Subdividing of Tract X-4-A-1-A & Tract X-f-4-A-2, Phase 2 – Lots 101 thru 110, portion of additions to Cinclare Plantation from R-6 (Town Home Residential) to R-5 (Zero Lot Line Residential) at the request of Tatum Engineering for property owners River Mill Reserve LLC and Ace Holdings LLC, property address: West St. Francis Street, Brusly, was read aloud and opened for Public Hearing by Mayor Normand. Jim Tatum spoke briefly explaining the request. Mr. Tatum asked the Council to modify the request to include only lots 1-10 instead of the entire plat. Opposition to the rezoning was expressed by Steve Taylor of the Brusly Oaks Homeowners Association. Hearing no other comments from the public, the Mayor turned the issue over to the Council for consideration. After a brief discussion clarifying the lots to be rezoned a motion to adopt was made by Council Member Kershaw; seconded by Council Member Olinde. A roll call was had with the following results:

Mayor Normand read aloud a request for approval of the Preliminary Plat showing Subdivision of Property: West St. Francis Street, River Mill Reserve, Phase 2, Zero Lot Line Residential Development – Second Filing – Lots 101 thru 110. Being Tract X-4-A-1-A and Tract X-4-A-2, portion of additions to Cinclare Plantation, located in Sections 15 & 16, T8S, R12E, Southeastern Land District, West of the Mississippi River, West Baton Rouge Parish for Ace Holdings, LLC. The Mayor opened the floor for public comment. Hearing no comments, Mayor Normand turned it over to the Council for consideration.
After a brief discussion a motion to approve the amended preliminary plat was made by Council Member André; seconded by Council Member Kershaw. A roll call vote was had with the following results:

After the vote Mayor Normand showed everyone a veto letter he drafted in anticipation of passage of the ordinance. He stated he would not veto this ordinance inasmuch as it had been scaled back to ten lots, but would veto future ordinances if the developer did not keep his promises of high quality, owner-occupied housing.

Ordinance #3 of 2011 – To amend the appropriations ordinance of 2010-2011 to provide relative to appropriations for the income and expenses of the Town was read aloud and opened for Public Hearing by Mayor Normand. Hearing no comments from the public, Mayor Normand turned the issue over to the Council for Consideration. A motion to adopt Ordinance #3 of 2011 as presented was made by Council Member Bourgeois; seconded by Council Member Olinde. A roll call vote was had with the following result:

Ordinance #4 of 2011 – To amend and re-enact the Code of Ordinances, Chapter 6- Licensing and Regulations, relative to Article B-Amusements, Section 6.12 permit required for use of streets was read aloud and opened for Public Hearing by Mayor Normand. After hearing no comments from the public, the Mayor closed the Public Hearing and presented the Ordinance to the Council for consideration. After some discussion a motion to adopt Ordinance #4 of 2011 as presented was made by Council Member André; seconded by Council Member Bourgeois. A roll call vote was had with the following result:

Police Department Report:
Report for the month of March was given by Chief Jamie Whaley. There were fifteen (15) wrecks, forty (40) bench warrant arrests, two (2) damage to property, two (2) disturbing the peace, two (2) alarms, fourteen (14) assists to other agencies, one (1) 911 call, three (3) juvenile matters, eleven (11) traffic arrests and fifteen (15) miscellaneous calls. For the month’s total, there were 105 calls, 168 citations and 216 violations.

Mayor’s Report:
Mayor Normand attended a Chamber of Commerce after hours function, a Relay for Life Proclamation signing, a Planning Organization meeting, the CRPC meeting in Addis and the Education Committee meeting at Brusly High School. The Mayor announced the recipients of the Teacher of the Year Award; Beth Haydel at Brusly Middle School and Sara Guillory at Brusly High School. Mayor Normand taught four Chemistry classes at Brusly High School and attended an EOC meeting to discuss the purchase of a new Mobile Command Center. Mayor Normand announced that the Town of Brusly had received Tree City and Growth Award.
Remarks of Personal Privilege:
Council Member André announced that the Brusly High Baseball Team played a game dedicated to Relay for Life and collected about $900.00 in donations.

A motion was made by Council Member Olinde to adjourn; seconded by Council Member Hebert. The motion passed with a unanimous vote. The meeting adjourned at 7:32 PM.
