BRUSLY PLANNING COMMISSION MINUTES
May 26, 2004

A regular meeting of the Brusly Planning Commission was held on Wednesday, May 26, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:35 PM following the Zoning meeting.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Shane Sarradet, Claudette Purnell.

Members absent: Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler, Joanne Bourgeois, Chris Kershaw, Mr. & Mrs. Walter Dugas, Murray McCullough, and a group of approximately 25 interested citizens.

Upon motion of Mr. Carroll Fontenot, seconded by Mr. Jules Thibodaux, the minutes of the April 28, 2004 meeting were approved as written. Motion carried unanimously.

Public Hearing:

The Chairperson opened the public hearing on the Preliminary Plat of Back Brusly Acres Master Plan (1st, 2nd, 3rd, & 4th Filings)” submitted by Benchmark Group, LLC for Walter J. Dugas.

Mr. Murray McCullough with the Benchmark Group, LLC presented the plat for Mr. & Mrs. Dugas. He advised that the changes requested on the plat from the last meeting have been made. He stated that Mr. Dugas wishes to divide his property into eight tracts and proposes to use the four existing rights-of-way from Live Oak Drive for access to said tracts. Mr. Dugas proposes that since the Town of Brusly owns the rights-of-way, the town is responsible for constructing the roadway, drainage and sewer to his property line. He will be responsible for continuing the roadway, sewer and drainage through his property to his northern property line.

The Chairperson asked for questions or comments from the public. Following are items discussed:

• Responsibility for cost of improving the right-of-ways and extending sewerage and utilities from Live Oak Drive to the southern boundary of Mr. Dugas’ property.

• The cost effectiveness for the town to improve and maintain a street approximately 300’ to service two residences.

• Intent of rights-of-way.

• Persons who have purchased land being prevented from developing that land by being denied use of rights-of-way that are required by town ordinance for future development.

• Developers being allowed by former administrations to get by without improving the required rights-of-way and who should pay since they have been accepted into the town system.

• The town acceptance of the extension of the Live Oak rights-of-way without making provisions for future improvements when the Rodriguez and Hill properties were sold.

• Possibility of future development of the properties adjoining ROW on the northern boundary of Mr. Dugas’ property.

• Fire department concerns for the location of fire hydrants, and burning of debris from the cleared property.

• Drainage.

• Conformance to residential lot code.

• Restrictions on further development of the proposed tracts.

These items were discussed at length. Although it was announced at the beginning of the public hearing that the commission would be reviewing the plat and the responsibility of who will pay for improvements to the rights-of-way would not be discussed, this was the main concern and it kept coming up over and over. No one voiced opposition to the subdivision.

Mr. Dugas was recognized. He referred to the minutes of a meeting of the Brusly Town council on January 9, 1995 wherein upon motion of Alderman Mancuso, seconded by Alderman Guillot, the council agreed to “blacktop a road from Live Oak Drive to the property line of the Nolan Daigle property on or after July 1, 1995 provided Mr. Walter “Dub” Dugas, the developer, is given proper approval by the planning and zoning commission.” It was also noted in the minutes of the January 9, 1995 meeting that Alderman Rhodes stated that the Town should also place the sewer line to the Daigle property and the developer will be responsible to connect same.

Mrs. Rosa Stelly asked why he waited nine years before coming to the commission with his development proposal. Mr. Dugas’ answer was “financial”. He stated that he went before the council at that time to seek out his options for development before purchasing the property.

There was no further discussion. The Chairperson closed the public hearing.

Mrs. Rosa Stelly made a motion to reject the Preliminary Plat of Back Brusly Acres Master Plan (1st, 2nd, 3rd, & 4th Filings)” submitted by Benchmark Group, LLC for Walter J. Dugas with the statement that the roads, drainage and utilities are not in place at this time and Mr. Dugas should seek resolution of the responsibility for these improvements with the Mayor and Town Council prior to any re-submittal. Mr. Carroll Fontenot seconded the motion and it carried unanimously.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mrs. Claudette Purnell seconded the motion and it carried unanimously.

The meeting of the Planning Commission adjourned at 7:45 PM.

A regular monthly meeting of the Brusly Zoning Commission was held on Wednesday, May 26, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 PM.
