MINUTES OF THE BRUSLY PLANNING COMMISSION
NOVEMBER 29, 2006
A regular meeting of the Brusly Planning Commission was held on Wednesday November 29, 2006 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Mrs. Debbie Thompson, Chairperson at 6:30 PM.
Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Claudette Purnell, Steve Perkins.
Members absent: None.
Others present: Marianne Berthelot, Mayor Joey Normand, Joanne Bourgeois,
Mr. & Mrs. Durwin Wunstell, Cletus Langlois, Wiley Hebert, Sr.
and a group of Allene Subdivision residents.
Upon motion of, Mrs. Rosa Stelly seconded by Mr. Carroll Fontenot, the Minutes of the October 25, 2006 meeting were approved as written. Motion carried unanimously.
Chairperson Debbie Thompson opened the Public Hearing on the following resubdivision request:
Resubdivision of Lot 18-A-1, Bezet Estate Property into Lots 18-A-1-1 through 18-A-1-4 For Durwin J. Wunstell, Sr.
Mrs. Thompson read a petition signed and submitted by forty-seven residents of Allene Subdivision who opposed the resubdivision of this property due to the close proximity of the access servitude to the adjoining properties on Allene Street. Other concerns stated in the petition were the traffic that would be generated by having four families using the servitude, the potential drainage problems it could cause and the placement of mail boxes and the placement of garbage cans and trash since the only frontage on Allene street would be the width of the 20’ private servitude access to the proposed lots.
At this time, Mrs. Thompson stated that she would recuse herself from voting on this matter due to her property adjoining Mr. Wunstell’s property.
Mr. Cletus Langlois with Patin Engineers was recognized. He submitted the revised plat showing the resubdivision of Lot 18-A-1 into four lots as requested at the October 25th meeting. He advised that they meet all the ordinance requirements for this type of subdivision and no variances are needed or requested. He addressed the concerns of the adjoining property owners as follows:
1. Drainage. No drainage will go North to Allene Street. They plan to use the ditch on the back of Mr. Wunstell’s property.
2. Mail Boxes, Garbage Cans, etc. Upon checking with an attorney, the property owners of this proposed subdivision can use the town utility servitude along Allene Street for this purpose.
Mrs. Elaine Richard, 2187 Allene Street was recognized. She addressed the commission stating that she is the person who will be most affected by this proposed subdivision since the access servitude is only seven feet (7’) from the foundation of her home. She had concerns for health issues that could be caused from the dust generated from a limestone road so close to her home. She also opposed the having mailboxes, garbage and trash from four lots placed on the servitude in front of her home.

Mr. Wiley Hebert, Jr. was recognized. He stated that he is the property owner who adjoins the servitude on the East and it is sixteen feet (16’) from his home. He had the same concerns as Mrs. Richard and also opposed the placement of mail boxes, garbage and trash in front of his home. He had concerns regarding the heavy traffic that would be generated from delivery trucks during construction of homes on the proposed lots, especially concrete delivery trucks that could possibly damage the foundations of his and Mrs. Richard’s homes.
Several other residents were heard. Opposition was voiced with regards to the Town allowing this type of subdivision with gravel road access. They felt it was unfair to the community.
Mr. Langlois was recognized again and reiterated that the proposed subdivision meets all ordinance requirements and in fact, the servitude is five feet wider that the requirement of the ordinance. He asked that the commission take this into consideration and vote favorably on the request of Mr. Wunstell.
Discussion ended and the chairperson closed the Public Hearing at 7:00 PM.
Mr. Shane Sarradet was recognized. He stated that it is obvious that all criteria is met but being 100% in compliance is not all there is to consider since there is a petition signed by 47 residents of the area opposing the subdivision. Therefore, he would like to make a motion to recommend that the Town Council deny the request submitted by Mr. Wunstell for resubdivision of Lot 18-A-1, Bezet Estate Property. Mrs. Rosa Stelly seconded the motion. Motion carried with a roll call vote of 6 yeas and one recused.
Mayor Joey Normand was recognized. He advised those who have interest in the outcome of this request to attend the committee meeting of the Town Council on the first Monday of December. The committee meetings are where matters are taken up and discussed with audience participation. The official Town Meeting is held on the second Monday of the month for the official vote. Audience participation is not allowed during this meeting.
There was no other business to come before the Planning Commission.
Mr. Carroll Fontenot made a motion to adjourn. Mrs. Rosa Stelly seconded the motion and it carried unanimously.
The meeting of the Planning Commission adjourned at 7:05 PM.

Under other business Mr. Skipper Grady was recognized. He announced that there is a petition circulating promoting a request that the Parish Council consider paving a bicycle trail along the Mississippi River Levee from the Port Allen Locks to the southern parish line. This will be similar to the one that was done in Baton Rouge and he asked that those interested in this project make an effort to sign the petition.
There was no other business to come before the Zoning Commission.
Mr. Carroll Fontenot made a motion to adjourn. Mrs. Rosa Stelly seconded the motion and it carried unanimously.
The meeting of the Zoning Commission adjourned at 7:10 PM.
