BRUSLY PLANNING COMMISSION MINUTES
April 27, 2005

A regular meeting of the Brusly Planning Commission was held on Wednesday, April 27, 2005, in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 PM.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Steve Perkins.

Members absent: Claudette Purnell

Others present: Marianne Berthelot, Mayor Joey Normand, Joanne Bourgeois,
Chris Kershaw, David Rodrigue, Everett LaBauve, Skipper Grady,
and members of the Press.

Upon motion of Mrs. Rosa Stelly, seconded by Jules Thibodaux, the Minutes of the March 23, 2005 meeting were approved as written. Motion carried unanimously.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mr. Shane Sarradet seconded the motion and it carried unanimously.

The meeting of the Planning Commission adjourned at 6:35 PM.

MINUTES OF BRUSLY ZONING COMMISSION
April 27, 2005

 

A regular monthly meeting of the Brusly Zoning Commission was held on Wednesday, April 27, 2005 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:36 PM.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Steve Perkins.

Members absent: Claudette Purnell.

 

Others present: Marianne Berthelot, Mayor Joey Normand, Joanne Bourgeois,
Chris Kershaw, David Rodrigue, Everett LaBauve, Skipper Grady,
and members of the Press.

Upon motion of Mr. Carroll Fontenot, seconded by Mr. Shane Sarradet, the Minutes of the March 23, 2005 meeting were approved as written. Motion carried unanimously.

VARIANCE REQUEST:

George “Skipper” Grady requesting re-consideration of his request for a variance on Street/Right-of-Way requirements to obtain a building permit to build a home on Lot 6-A, Duraldville Subdivision.

Mayor Joey Normand was recognized. He stated that he had several meetings with Mr. Grady in the past few days and read a memo he sent to the Planning & Zoning Commission stating his support of awarding a variance which will provide a variance from the requirement that Mr. Grady’s lot must front on a street. He asked for a recommendation from the Zoning Commission in favor of the variance with the following stipulations.

1. Blanchard street is improved the existing width of Blanchard Street and a distance of not less than 20’ to the West. The exact distance to be established by the Brusly Town Council as part of the motion granting the variance.

2. All improvements must be completed and accepted before an occupancy permit is issued.

3. The improvements will be done in compliance with sections 19-17, 19-18, 19-19 (a), (b), (c) and (d) and Appendix A, B, and C with the exception of the street width and length as described in #1 above.

4. The variance, and all its terms and conditions, shall be recorded in the conveyance records of West Baton Rouge Parish for lot 6-A. The recording cost to be borne by the Town of Brusly.

In the memo he referred to action taken by the Brusly Town Council at their April 11, 2005 meeting wherein the Council voted against a variance which would have required 40’ of improvements to Blanchard Street. (A copy of said memo is made part of these minutes.

The chairperson asked Mr. Grady if he was in agreement with this recommendation. Mr. Grady stated that he and the Mayor tried to work things out but maintained that the conditions suggested are too restrictive and that he is being treated as a developer when in fact he is not subdividing, only asking for a variance on a “lot of record”. He referred to the definition of a “lot of record” in the Zoning Ordinance and contended that since the said lot was approved and accepted by the Brusly Town Council in 1999 he should not have to follow the restrictions set out in n the Subdivision Ordinance. He referred to lot 6 going back to 1904 and stated that upon the recommendation of the Mayor and Council at that time, he resubdivided the lot to bring the lot line to the end of the pavement on Blanchard Street. He maintained that this lot should be “grandfathered” since it was approved and accepted before new regulations went into effect.

He brought up constructing a limestone “T” turn-around instead of an extension to Blanchard street to access his driveway; and also referred to several other lots that do not front on a paved street that the owners were issued building permits. The Chairperson called for order and advised Mr. Grady that discussion would be on the lot in question.

Councilman Chris Kershaw was recognized. He stated that they worked extremely hard to revise the ordinances and he could not vote for using limestone on a public right of way. Mrs. Joanne Bourgeois , Councilwoman also commented on this.

Mrs. Rosa Stelly was recognized. She stated that because of unsettled issues and comments made she would like to make it known that commission members give a lot of thought and time to researching the issues that come before them before making a recommendation.

The Chairperson called for a motion.

Mrs. Rosa Stelly made a motion to recommend the Mayor’s plan to the Town Council for approval. Mr. Jules Thibodaux seconded the motion and it carried unanimously.

There was no other business to come before the Zoning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mrs. Rosa Stelly seconded the motion and it carried unanimously.

The meeting of the Zoning Commission adjourned at 7:30 PM.
