BRUSLY PLANNING COMMISSION MINUTES
January 28, 2004

A regular meeting of the Brusly Planning Commission was held on Wednesday, January 28, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Shane Sarradet

Members absent: Claudette Purnell, Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler, Chris Kershaw, Joanne Bourgeois, Keith Birch, Danny Rabalais, Kenny Hunts, Fred McKenzie.

Upon motion of Mr. Carroll Fontenot seconded by Mr. Jules Thibodaux , the minutes of the December 17, 2003 meeting were approved as written. Motion carried unanimously.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mrs. Rosa Stelly seconded the motion and it carried unanimously.

The meeting of the Planning Commission adjourned at 6:35 P.M.

MINUTES OF BRUSLY ZONING COMMISSION
January 28, 2004

A regular monthly meeting of the Brusly Zoning Commission was held on Wednesday, January 28, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Claudette Purnell, Shane Sarradet.

Members absent: Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler, Chris Kershaw, Joanne Bourgeois, Kenny Hunts, Mike Alleman.

Upon motion of Mr. Carroll Fontenot, seconded by Mrs. Rosa Stelly, the Minutes of the December 17, 2003 meeting were approved as written. Motion carried unanimously.

Discussion was resumed on the proposed amendment to the Zoning Ordinance changing side setback requirements from eight (8) feet to ten (10) feet to comply with NFPA code. A Public Hearing was held on December 17, 2003 with the commission deferring the matter to the January meeting in order for the Administration and Fire Department to come up with a draft of the proposed amendment for review.

Mayor Joey Normand was recognized. He provided copies of a rough draft of the proposed amendment and each residential zone was reviewed and discussed. The setbacks were changed to 10 ft. with a statement “may be 8 ft., provided an approved and tested one hour fire wall is used” . Members were in agreement with the change in zones R-1 through R-6 with the exception of zone R-3. Members were concerned since the minimum lot size area in this zone is 6,000 sq. ft. and a width of 50’ .

Mr. Don Neisler was recognized. He reiterated his statement made during the Public Hearing in December that by changing the setback to 10 feet in the R-3 zone the town would be penalizing the people in the old part of Brusly since most residences in this area come under the R-3 zone. He felt this would restrict the homeowners in this district from adding on to their present home or rebuilding.

The representatives of the fire department had some reservations about allowing the side setback to remain at 5 ft in R-3. After further discussion, it was agreed upon to change R-3 to 10 ft. also with the same statement to allow an 8’ setback provided a one hour fire wall is used and with an additional statement “may be 5 ft., provided an approved and tested four hour fire wall is used”.

In Zone R-5, a minor change removing the second to last sentence “all units must have a minimum of eight (8) feet between structure fascias” was discussed and agreed upon.

There was no further discussion and no opposition.

Mr. Carroll Fontenot made a motion to recommend the Town Council approve the proposed amendment to the Zoning Ordinance with the additional statement added in R-3 and the sentence deleted in R-5. Mrs. Rosa Stelly seconded the motion and it carried unanimously.

There was no other business to come before the Zoning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mrs. Claudette Purnell seconded the motion and it carried unanimously.

The meeting of the Zoning Commission adjourned at 7:00 P.M.
