MINUTES OF THE BRUSLY PLANNING & ZONING COMMISSION MEETING
January 22, 2014

The regular meeting of the Brusly Planning & Zoning Commission was held this date, January 22, 2014 at the Brusly Town Hall. Vice-Chair Ronda Perrault called the meeting to order at 6:30 PM.

Commissioner Broussard led the Pledge of Allegiance. A roll call determined the following officials present:
Vice-Chair: Ronda Perrault
Commissioners: Kim LeMoine, Wayne Broussard, Jeff Travasos, Gary Soniat, Claudette Purnell
Absent: Steve Perkins
Others present included Joanne Bourgeois, Don Neisler, Carroll Fontenot, Randall Loup, Wilfred & Tammy Dupuy and Cheryl Ordeneaux.

Vice-Chair Perrault opened the floor for nominations for the office of Planning & Zoning Chairperson. Commissioner Purnell nominated Commissioner Perrault. Commissioner Perrault respectfully declined the nomination. Commissioner Perrault nominated Commissioner LeMoine for the office of Planning & Zoning Chair; seconded by Commissioner Soniat. Commission LeMoine was elected Chairman with a unanimous vote.

Chairman LeMoine then presided over the meeting. He welcomed newly- appointed Commissioner Wayne Broussard to the Commission.

A motion to approve the minutes of December 18, 2013 regular meeting of the Planning & Zoning, as written, was made by Commissioner Perrault and seconded by Commissioner Soniat. The minutes were approved unanimously.

Planning:
Chairman LeMoine read aloud a variance request, for Non-Compliance, Sec. 19.6 Right of Way Encroachment for Wilfred Dupuy at 1685 Pecan Street. Mr. Dupuy is requesting the variance to add an awning on an existing shop; said awning will encroach 10 feet into the servitude of passage. At the invitation of Chairman LeMoine, Mr. Wilfred Dupuy explained his variance request to the Board. Following a brief discussion, a motion to recommend to the Town Council the variance of encroachment upon the servitude of passage by 10 feet was made by Commissioner Perrault; seconded by Commissioner Purnell. A roll call vote was had with the following results:
Yeas: Broussard, Travasos, Soniat, Purnell, LeMoine, Perrault
Nays: None
Absent: Perkins

Chairman LeMoine read aloud a variance request for Non-Compliance, Sec. 19.6 Servitude Encroachment for Shawn Aguillard at 388 River Mill Drive to encroach upon the sewer servitude to build a fence. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner Travasos; seconded by Commissioner Soniat. A roll call vote was had with the following results:
Yeas: Travasos, Soniat, Purnell, LeMoine, Perrault, Broussard
Nays: None
Absent: Perkins

Zoning:
Chairman LeMoine read aloud variance request for Non-Compliance, Sec. 19.31.1 Zoning District R-1, Side & Rear Setbacks for Randall Loup at 448 Quiet Oak Blvd. to build a pool house.

At the invitation of Chairman LeMoine, Mr. Loup explained the variance request, stating he owned the adjoining properties of 468 and 448 Quiet Oak Blvd. The variance request was to build a pool house on the property line between the two lots and 5 feet from the rear property line. Commissioners discussed drainage issues which had been brought to their attention by Mr. Caleb Kleinpeter, the property owner facing W. Main Street, to the rear of Mr. Loup’s property. Commissioner Perrault added the reason for setbacks was for fire protection and questioned if the variance would have a negative effect in that regard. Mr. Loup pointed out that the drainage servitude was located beyond his property lines and that the pool house would be built of brick, posing as a good fire barrier.

Commissioner Travasos made a motion to table the variance request until the further information can be gathered. The motion failed for lack of a second.
After further discussion, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner Soniat. A roll call vote was had with the following results:
Yeas: Soniat, Purnell, LeMoine, Perrault, Broussard
Nays: Travasos
Absent: Perkins

A motion was made by Commissioner Travasos to adjourn; seconded by Commissioner Perrault. The motion passed with a unanimous vote. The meeting adjourned at 7:03 PM.
