BRUSLY PLANNING COMMISSION MINUTES
February 25, 2004

A regular meeting of the Brusly Planning Commission was held on Wednesday, February 25, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 6:30 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Shane Sarradet

Members absent: Claudette Purnell, Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler, Joanne Bourgeois, Mr. & Mrs. Keith Birch, Woody Triche, Howard Stelly.

Upon motion of Mr. Carroll Fontenot seconded by Mrs. Rosa Stelly, the minutes of the January 28, 2004 meeting were approved as written. Motion carried unanimously.

Next on the agenda was a request from residents of Orleans Quarters Subdivision for a variance to allow individual lot owners to build a fence on the rear servitude along the property line. Mayor Joey Normand was recognized. He advised the commission that culverts will be placed in the drainage ditch in the rear of the Orleans Quarters lots with a catch basin located on the corner of each lot and in the near future, the servitude will be reduced from 30’ to 10’. He advised that the town attorney has drawn up an agreement for each individual lot owner to sign prior to building the fence. The agreement gives permission for the Town to cross their property and remove the fence if necessary in order to do any maintenance or repairs to the drainage at no cost to the town. The homeowner would be responsible for replacing the fence.

A draft of the agreement was given to the members of the commission for review. Mr. Woody Triche was recognized. He suggested that unless there is control of the type of fence to be built, a fence could possibly restrict water flow and cause a problem. Members of the commission agreed and felt this should be addressed. It was suggested that the attorney add a statement in the agreement that the town must approve the type and design of the fence. There was no further discussion on this matter.

Mr. Jules Thibodaux made a motion to recommend approval of the variance allowing residents of Orleans Quarters Subdivision to build a fence on the rear servitude contingent upon addition of a statement that the town must approve the type and design of the fence. Mr. Carroll Fontenot seconded the motion and it carried unanimously.

Under other business, Mr. Woody Triche presented a plat entitled “Final Plat of Map Showing the Subdivision of Lot 40 Live Oak Place and Lots 39-A & 40-A of the Romey Dupuy Heirs Property into Lots 39-A-1 and 40-A-1 for Emery L. Broussard and Howard G. Stelly. He advised the commission that this division is between adjoining property owners and is not creating another lot or building site.

At this time, Mrs. Rosa Stelly recused herself from the discussion.

Commission members felt this division to be an improvement to a bad situation wherein Lot 40-A was land locked and after some discussion it was determined that this plat can be approved administratively subject to Mr. Triche adding the statement for division between adjoining property owners to the plat.

There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mr. Jules Thibodaux seconded the motion and it carried unanimously.

The meeting of the Planning Commission adjourned at 6:58 P.M.

A regular monthly meeting of the Brusly Zoning Commission was held on Wednesday, February 25, 2004 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. The meeting was called to order by Chairperson Debbie Thompson at 7:00 P.M.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson, Rosa Stelly, Shane Sarradet.

Members absent: Claudette Purnell, Leslie Crockett.

Others present: Marianne Berthelot, Mayor Joey Normand, Don Neisler, Joanne Bourgeois, Mr. & Mrs. Keith Birch, Woody Triche, Howard Stelly.

The meeting of the Zoning Commission adjourned at 7:00 P.M.
