Town Planning & Zoning Meeting Minutes – Wednesday, August 28, 2013

MINUTES OF THE BRUSLY PLANNING & ZONING COMMISSION MEETING
August 28, 2013

The regular meeting of the Brusly Planning & Zoning Commission was held this date, August 28, 2013 at the Brusly Town Hall. Chairperson Rosa Stelly called the meeting to order at 6:30 PM.

Commissioner LeMoine led the Pledge of Allegiance. A roll call determined the following officials present:

Commissioners: Kim LeMoine, Ronda Perrault, Jeff Travasos, Gary Soniat,
Steve Perkins
Absent: Claudette Purnell
Others present included Joanne Bourgeois, Don Neisler, Joey Normand, Kirk and Toni Mancuso, Toby Easterly, Michael Martinez, Shane Sarradet and Alcide Berthelot.

Commissioner Claudette Purnell arrived at 6:32 pm.

A motion to approve the minutes of the Planning & Zoning regular meeting of July 24, 2013 as written was made by Commissioner Travasos and seconded by Commissioner Perrault. The minutes were approved unanimously.

Zoning:
Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.31.1 Zoning District R-1- Front Setback from DSLD, LLC for Orleans West Subdivision, Phase 2, to reduce the front setback from 30’ to 20’. Mr. Toby Easterly presented the proposed variance stating that the Town had suggested the change. Mayor Normand explained that the variance would create more footage for the rear drainage servitude of each lot.
After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner LeMoine; seconded by Commissioner Perkins. A roll call vote was had with the following results:
Yeas: Stelly, Travasos, Soniat, Perkins, Purnell, LeMoine, Perrault
Nays: None
Absent: None

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.31.1 Zoning District R-1- Front Setback from DAGR, LLC for Orleans West Subdivision, Phase 3, to reduce the front setback from 30’ to 20’. The Phase 3 variance request being the same as the Phase 2 variance request, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner Purnell. A roll call vote was had with the following results:
Yeas: Travasos, Soniat, Perkins, Purnell, LeMoine, Perrault, Stelly
Nays: None
Absent: None

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 18.13 (c) Accessory Structures/Uses from Kirk Mancuso at 755 Venzule St. to add a shower to an accessory structure. Chairperson Stelly recognized Mr. Kirk Mancuso. Mr. Mancuso presented the variance request, assuring the Commission that the shower facility was to be used for a pool house only. With the stipulation that the structure would not be occupied as a residence, a motion to recommend the variance to the Town Council, was made by Commissioner Soniat; seconded by Commissioner Purnell. A roll call vote was had with the following results:
Yeas: Soniat, Perkins, Purnell, LeMoine, Perrault, Stelly, Travasos

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 18.1 (8) Carport from Michael Martinez at 1760 Allene St. to reduce the setback from 18” to 0”. Chairperson Stelly recognized Mr. Martinez, who explained the request. Mr. Martinez stated that the adjoining neighbor, Mr. Sarradet did not have any objections to the variance request. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner LeMoine; seconded by Commissioner Soniat. A roll call vote was had with the following results:
Yeas: Perkins, Purnell, LeMoine, Perrault, Stelly, Travasos, Soniat
Nays: None
Absent: None

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.31.1 Zoning District R-1- Rear Setback from Alcide Berthelot at 2403 Orleans Quarters Dr. to reduce the setback from 10’ to 0’ and to encroach upon the drainage servitude for the purpose of building a storage shed. Chairperson Stelly recognized Mr. Berthelot, who explained the request. Mr. Berthelot stated that the adjoining neighbor did not have any objections to the variance request. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner Travasos. A roll call vote was had with the following results:
Yeas: Purnell, LeMoine, Perrault, Stelly, Travasos, Soniat, Perkins
Nays: None
Absent: None

Chairperson Stelly read aloud a Variance Request for Non Compliance – Sec. 19.6 Drainage Servitude Encroachment for Alcide Berthelot at 2403 Orleans Quarters Dr. to encroach upon the servitude by 5’ for the purposes of building a screen porch on the rear of his house. Chairperson Stelly recognized Mr. Berthelot, who explained the request. After a brief discussion, a motion to recommend the variance to the Town Council was made by Commissioner Perrault; seconded by Commissioner Travasos. A roll call vote was had with the following results:
Yeas: LeMoine, Perrault, Stelly, Travasos, Soniat, Perkins, Purnell
Nays: None
Absent: None

Announcements:
A Planning Commission Training Workshop will be held Sept. 7th from 8:00 AM to 12:00 PM at the Walker City Hall.
The Town Committee Meeting will be held Tuesday Sept. 3rd.
The Town Regular Meeting will be held Monday Sept. 9th.

A motion was made by Commissioner LeMoine to adjourn; seconded by Commissioner Soniat. The motion passed with a unanimous vote. The meeting adjourned at 7:24 PM.
