Town Planning & Zoning Meeting Minutes – Wednesday, August 22, 2007

MINUTES OF THE BRUSLY PLANNING COMMISSION
AUGUST 22, 2007

A regular meeting of the Brusly Planning Commission was held on Wednesday, August 22, 2007 in the Council Meeting Room, Brusly Town Hall, and Brusly, Louisiana. Mrs. Debbie Thompson, Chairperson called the meeting to order at 6:30 PM.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Steve Perkins.

Members absent: Claudette Purnell.

Others present: Marianne Berthelot, Joey Normand, Joanne Bourgeois,
Chris Kershaw, Don Neisler, Mike Alleman, Kenny Hunts,
Fred McKenzie, Jim Tatum, Cletus Langlois, Jason Safford
and several residents of Brusly Oaks Subdivision.

Upon motion of Mrs. Rosa Stelly, seconded by Mr. Shane Sarradet, the Minutes of the June 27, 2007 meeting were approved as written. Motion carried unanimously. There was no meeting in July due to lack of a quorum.

The “Preliminary Sketch of Oak Plaza Drive Extension” for H. L. Laws & Company, Inc. was the first item on the agenda. Mr. Jim Tatum of Tatum Engineers was present and representing H. L. Laws. Members of the Brusly Fire Department and Police Chief Jamie Whaley were present to support this proposal. Fire Chief Mike Alleman gave a list of reasons why the fire department, with concern for public safety in mind, is in favor of opening Oak Plaza Drive as a through street:

• Additional commercial establishments locating on the remaining Laws property would only have one access in case of fire and the fire rating could be lost without the ability to send trucks from two directions.

• It would provide another outlet for residents of the Gates at the Oaks Subdivision in case of an emergency, major traffic accident or spill on LA 1.

• The street could be used as a secondary route for LA 1 traffic in case of a major traffic accident or spill on LA 1.

• Additional fire hydrant and water lines would be installed at no cost to the fire department or the town.

Police Chief Jamie Whaley reiterated Chief Alleman’s concern for public safety and wants to look into possible situations with traffic backup during peak hours on LA 1 and Main Street. The victims can visit personal injury attorney in myrtle beach to file for a compensation for their loss because of this accident.

The possibility of a traffic study and the need for public input was discussed.

Mrs. Rosa Stelly made a motion to schedule and advertise a special meeting to hear public input on this proposal. Mr. Carroll Fontenot seconded the motion and it carried unanimously. The special meeting will be held at 6:30 PM, September 26, 2007 with the regularly scheduled meeting immediately following.

Because the next item on the agenda “Final plat showing the Resubdivision of Lot 12 of Hebert Subdivision and a 40’ strip of property into Lots 12-A and 12-B for Allains, LLC” requires rezoning, Mr.

Jules Thibodaux made a motion to suspend the Planning Commission Meeting and open the Zoning Meeting. Mrs. Rosa Stelly seconded the motion and it carried unanimously.

MINUTES OF THE BRUSLY ZONING COMMISSION
AUGUST 22, 2007

A regular meeting of the Brusly Zoning Commission was held on Wednesday June 27, 2007 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. Mrs. Debbie Thompson, Chairperson called the meeting to order.

Members present: Jules Thibodaux, Carroll Fontenot, Debbie Thompson,
Rosa Stelly, Shane Sarradet, Steve Perkins.

Members absent: Claudette Purnell.

Others present: Marianne Berthelot, Joey Normand, Joanne Bourgeois,
Chris Kershaw, Don Neisler, Mike Alleman, Kenny Hunts,
Fred McKenzie, Jim Tatum, Cletus Langlois, Jason Safford
and several residents of Brusly Oaks Subdivision.

Upon motion of Mr. Shane Sarradet, seconded by Mr. Steve Perkins, the Minutes of the June 27, 2007 meeting were approved as written. Motion carried unanimously. There was no meeting in July due to lack of a quorum.

Mr. Cletus Langlois with Patin Engineers introduced the request for rezoning of Lot 12 of Hebert Subdivision and a 40’ strip of property from R-1 to R-2. He advised that Allains, LLC is the owner of Lot #12 and the 40’ strip. In order to resubdivide the property and meet lot size requirements they need rezoning to R-2.

Mrs. Rosa Stelly made a motion to send this request to Public Hearing. Mr. Jules Thibodaux seconded the motion and it carried unanimously. The Public Hearing will be held on September 26, 2007 during the regular meeting of the Zoning Commission.

There was no other business to come before the Zoning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mr. Shane Sarradet seconded the motion and it carried unanimously.

Mr. Carroll Fontenot made a motion to re-open the meeting of the Planning Commission. Mr. Shane Sarradet seconded the motion and it carried unanimously.

The Chairperson called the meeting to order and the next item on the agenda was taken up.

Plats Submitted:

1. Final plat showing the Resubdivision of Lot 12 of Hebert Subdivision and a 40’ strip of property into Lots 12-A and 12B for Allains, LLC.

Mrs. Rosa Stelly made a motion to send this resubdivision request to public hearing. Mr. Carroll Fontenot seconded the motion and it carried unanimously. The public hearing will be held on September 26, 2007 during the regularly scheduled meeting of the Planning Commission.

2. “Map showing Resubdivision of Tract CA-1 Brusly Oaks Subdivision into Lot 84 and Tract CA-1-A for DSDC LLC.”

The secretary advised the commission members that their copies of the plat and the agenda showed that this resubdivision is for Brusly Oaks Homeowners Association when in fact, the Assessor’s Office records show DSDC, LLC as owner. Mr. Jim Tatum with Tatum Engineers had a corrected copy of the plat and advised that corrected copies would be forwarded prior to the next meeting. He advised that Mr. Safford’s plan is to donate this property to the homeowners association. He is resubdividing it to add a residential lot to the subdivision. This will allow the homeowners association to sell the lot and use the proceeds towards improvements on the Tract CA-1-A.

Mrs. Emily Petigo was recognized. She stated that she is the administrator for the Brusly Oaks Homeowners Association and that she and several other residents met with Mr. Safford regarding the donation of the property and they are in agreement with this proposed resubdivision.

Mr. Carroll Fontenot made a motion to send this resubdivision request to public hearing. Mr. Jules Thibodaux seconded the motion and it carried unanimously. The public hearing will be held on September 26, 2007 during the regularly scheduled meeting of the Planning Commission.

Mr. Thomas Olinde was recognized. He stated that as a resident of Brusly Oaks Subdivision he was unaware of any discussion or agreement with Mr. Safford and his guess would be that probably 90% of the residents are unaware.
There was no other business to come before the Planning Commission.

Mr. Carroll Fontenot made a motion to adjourn. Mr. Steve Perkins seconded the motion and it carried unanimously.

The meeting of the Planning Commission adjourned at 7:50 PM.
