MINUTES OF THE BRUSLY PLANNING & ZONING COMMISSION MEETING
April 22, 2009

A regular meeting of the Brusly Planning & Zoning Commission was held on Wednesday April 22, 2009 in the Council Meeting Room, Brusly Town Hall, Brusly, Louisiana. Vice Chairman Carroll Fontenot called the meeting to order at 6:30 PM.

Members present: Jules Thibodaux, Carroll Fontenot, Rosa Stelly, Gary Soniat, Steve Perkins.

Members absent: Shane Sarradet, Claudette Purnell.
Others present: Marianne Berthelot, Mayor Joey Normand, Joanne Bourgeois, Mr. & Mrs. Landess Hebert, Lindsey Scott, Joel Tingle.

Upon motion by Mrs. Stelly, seconded by Mr. Thibodaux, the minutes of the March 25, 2009 meeting were approved as written.

PLANNING

1. Public Hearing on “Preliminary Subdivision Plat of a Tract of Land Known as the Currie Tract into Lots 1 – 6 located in Section 56, T8S, R12E, SLD, WBR Parish, Louisiana” for Joel P. Tingle.

Concerns for the possibility of increased traffic on Pecan Street was discussed. Mr. Tingle was present to answer questions. He stated that he will be building the homes on the lots and all driveways will connect to Allene Street. His explanation for the variance request on lots 1 and 2 is to preserve the beauty of the Oak Trees. There was no further discussion and no objection to this request. Mr. Fontenot closed the public hearing.

Mrs. Stelly made a motion to recommend approval of “Preliminary Subdivision Plat of a Tract of Land known as the Currie Tract into Lots 1 – 6, Located in Section 56, T8S, R12E, SLD, WBR Parish for Joel P. Tingle” with a five (5) foot variance on the front footage of Lots 1 and 2 and a stipulation of “No Driveways on Pecan Street”. Mr. Thibodaux seconded the motion and it carried unanimously.

ZONING

1. Variance Request – 467 Marionneaux Street – Lot # 40A, Southside Acres Subdivision. Daniel R. Scott requesting a side setback variance of nine (9) feet on the East side of his property.

Mrs. Scott was present and stated they are asking for a variance to move an existing building due to problems maneuvering their camper trailer into it without tearing up their yard. Mrs. Stelly asked if the building had been moved before and wanted to know its present location. Mrs. Scott stated that they constructed the building several years ago to house their motor home and were denied setback variances at that time. A question came up regarding the distance of the closest building on the neighbor’s property. Mrs. Scott could not answer the question. After further discussion Mr. Fontenot and Mrs. Stelly stated that they did not feel comfortable with just a one (1) foot setback. Mr. Fontenot called for motion.

Mr. Soniat made a motion to recommend approval of this request. Mr. Perkins seconded the motion and it passed with 3 ayes and 2 nays.

2. Members were informed that ORDINANCE NO. 2 OF 2009 was introduced to the town council on April 13th pursuant to LA R.S. 33:4724 and 33:4726 and a Public Hearing will be held by the Zoning Commission on Wednesday, May 27, 2009 at 6:30 PM.

Request: Re-Zoning From R-2 (Single-Family Residential) To C-1 (Light Commercial)
Address: 256 East Main Street, Brusly
Property: Lot 1, Square 20 Molaisonville, Town Of Brusly, Containing 0.846 Acres, More or Less belonging To Estates of Alex & Clelia Hebert (Requested by Rodney Varnell, Co-owner).

OTHER BUSINESS

1. A request for a variance submitted by Jonathan and Paula Bernard to construct a fence on the drainage servitude on the rear of their property at 408 Gleason Street.

Mr. Thibodaux made a motion to recommend approval of the fence variance. Mrs. Stelly seconded the motion and it carried unanimously.

There was no other business to come before the Planning and Zoning Commission.

Mr. Thibodaux made a motion to adjourn. Mr. Perkins seconded the motion and it carried unanimously.

The meeting adjourned at 7:00 PM.
