Town Meeting Minutes

The regular meeting of the Town of Brusly was held this date, June 13, 2016, at the Brusly Town Hall, at 6:30 p.m. Council Member Neisler led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor:                           Joey Normand
Council Members:      Scot Rhodes, Joanne Bourgeois, Terry Richard, Don Neisler
Town Attorney:           Thomas Acosta, Jr.
Absent:                          Shane Andrè

A motion to approve the minutes of the Town’s regular meeting of May 9, 2016, was made by Council Member Bourgeois and seconded by Council Member Rhodes. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Public Works Committee:
Mayor Normand made a recommendation to the Council to renew the Intergovernmental Agreement with the Parish for Inspection Services. Council Member Neisler made a motion authorizing the Mayor to sign the Intergovernmental Agreement; seconded by Council Member Richard. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Upon the recommendation of Mayor Normand and advice of Roy Waggenspack of Owen & White, a motion to accept the lowest bid of $265,970.00 from Hawkmoon Construction Services, LLC, for the Waste Water System Improvement Project-Venzule Pump Station & Forcemain Modifications, was made by Council Member Neisler; seconded by Council Member Rhodes. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Planning and Zoning Committee:
Mayor Normand read aloud a Variance Request for Non-Compliance – Sec. 19.31.1 Zoning District R-1 reducing the Side Setback from 10’ to 3’ for Connie Banta 3130 Live Oak Drive, to build a shed. The Variance having been favorably recommended by the Planning & Zoning Commission, a motion to approve was made by Council Member Richard; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Normand read aloud a Variance Request for Non-Compliance – Sec. 19.13.b for A.P. Dodson, LLC – Lots A-3, A-4, A-5, A-6 & A-7 Orleans West 2nd Filing, to reduce the utility servitude from 15’ to 10’. The Variance having been favorably recommended by the Planning & Zoning Commission, a motion to approve with the addition of Lot A-1, was made by Council Member Neisler; seconded by Council Member Rhodes. Mayor Normand opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Hearing and Final Action on Ordinances:
Mayor Normand read aloud Ordinance #6 of 2016, to make appropriations for the expenses of the Town of Brusly for 2016-2017 and to provide relative to the expenditure of said appropriations. Mayor Normand opened the public hearing. Hearing no comments the Mayor closed the public hearing and turned the matter over to the Council. After a brief discussion, Council Member Rhodes moved to approve the Budget as presented; seconded by Council Member Richard. The Mayor opened the floor for public comment. Hearing no comments, a roll call vote was taken with the following results:
Yeas: Richard, Bourgeois, Neisler, Rhodes
Nays: None
Absent: André

Ordinance 7 of 2016, to make appropriations for the expenses of the Town of Brusly Sewer System for 2016-2017 and to provide relative to the expenditure of said appropriations, was read aloud and opened for Public Hearing by Mayor Normand. Hearing no comments from the public, Mayor Normand directed the issue to the Council for consideration. A motion to adopt Ordinance 7 of 2016 as presented was made by Council Member Richard; seconded by Council Member Bourgeois. A roll call vote was had with the following result:
Yeas: Bourgeois, Neisler, Rhodes, Richard
Nays: None
Absent: André

Ordinance 8 of 2016, to amend and reenact the code of ordinances Chapter 4, Personnel, relative to section 4.16, Group Insurance for Retirees, was read aloud and opened for public hearing by Mayor Normand. Hearing no comments from the public, Mayor Normand directed the issue to the Council for consideration. A motion to adopt the ordinance as presented was made by Council Member Neisler; seconded by Council Member Rhodes. A roll call vote was had with the following result:
Yeas: Bourgeois, Neisler, Rhodes, Richard

Police Department Report:
Police Department Report for the month of May was given by Sgt. Gwen Cacioppo. There were nine (9) alarms, three (3) animal calls, four (4) assists to persons, four (4) assists to other departments, one (1) building check, one (1) damage to property, ten (10) disturbances, one (1) domestic call, one (1) fire call, one (1) forgery, one (1) found property, two (2) fraud calls, two (2) harassment calls, two (2) medical emergencies, two (2) miscellaneous calls, one (1) private property crash, one (1) roadway obstruction, one (1) robbery, one (1) suspicious act, three (3) thefts, seven (7) traffic accidents, two (2) traffic complaints, nine (9) traffic stops leading to an arrest, two (2) trespassing, and six (6) warrant arrests. For the month there were 77 total complaints, 245 citations, 287 violations and nine (9) no insurance tows.

Remarks of Personal Privilege:
Council Member Bourgeois thanked the Brusly Police Department for hosting their Open House Event. Council Member Bourgeois reported that she and Mayor Normand attended a Historical Marker Dedication Ceremony at Union Baptist Church.

Announcements:
The Town Hall will be closed July 4th in observance of Independence Day.
Town of Brusly Committee Meeting is changed from July 4th to July 5th.

A motion was made by Council Member Rhodes to adjourn; seconded by Council Member Richard. Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 6:46 PM.
