Town Meeting Minutes – September 2019

The regular meeting of the Town of Brusly was called to order this date, September 9, 2019, at the Brusly Town Hall, at 6:30 p.m. Council Member Richard led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor:                         Scot Rhodes
Council Members:         Rusty Daigle, Joanne Bourgeois, Terry Richard, Shane Andrè, Don Neisler
Town Attorney:            Thomas Acosta, Jr.
Absent:                         None

Recognitions & Commendations: None

A motion to approve the minutes of the Town’s regular meeting of August 12, 2019, as written, was made by Council Member Bourgeois and seconded by Council Member Richard. Mayor Rhodes opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Public Works Committee:
Mayor Rhodes read the Public Works Report, as prepared by Public Works Supervisor Shane Sarradet, for the month of August. There were 8 inches of rainfall in the month; LGAP funded sewer manhole coating was completed; catch basins on Anita St. and Lee Dr. were repaired and washed out; 2 SCADA alarms sounded; one “out of compliance” test result was noted at the sewer treatment facility; 340 feet of open ditch north of Archie LeJeune were cleaned and graded; 360 feet of open ditch on Venzule were cleaned and grated; Oak Plaza, First St., St. John, Landry, St. Mark and St. Matthew are being considered for overlay and/or patching; decorative street signs and poles for several streets in front Brusly were received; flags were put up prior to Labor Day and will fly through weekend following 9/11.

Regular bulk trash will be picked up the week of September 9, 2019. The extra trash pickup will be Friday, September 27, 2019.

Planning and Zoning Committee:
Mayor Rhodes presented the Final Plat of Map Showing subdivision of Lot 23, Allene Subdivision & Lot 23-A, J.C. Bezet, Sr. Estate Property into Lot 23-A-1 & 23-A-2 for William J. Tullier, II & Michelle Zito Tullier with Variance Request for Non-Compliance – Sec. 19.8(a)(5)k to allow more than 500 feet distance from the edge of the street right-of-way to the end of the private servitude of access. A motion to approve the plat with variance was made by Council Member Daigle; seconded by Council Member Neisler. The Mayor opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Mayor Rhodes presented the final construction plan and Final Plat Showing the Subdivision of a 16.562 Acre Tract of Land into Lots MT-1, MT-2 and MT-3 Located in Section 55, T8S-R12E Town of Brusly, West Baton Rouge Parish Southeastern Land District, West Baton Rouge Parish for Mark Tassin (621 N LaBauve Ave.). A motion to accept the final construction plan was made by Council Member André; seconded by Council Member Neisler. The Mayor opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Following the approval of the Construction Plan a motion to approve the Final Plat was made by Council Member Bourgeois; seconded by Council Member André. The Mayor opened the floor for public comments. Hearing no comments, the motion passed unanimously.

Finance Committee:
Mayor Rhodes noted that the “Budget to Actual Comparison Report” was included in the meeting packets for Council Members to review.

Recreation Committee: None
Personnel Committee: None

Police Committee:
Upon the recommendation of Police Chief Lefeaux, Council Member Richard made a motion to hire Ronald Tetzel as a Full Time Police Officer at the rate of $16.00 an hour, effective September 14, 2019; seconded by Council Member André. Mayor Rhodes opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Governmental Affairs Committee:
Upon the recommendation of Mayor Rhodes, a motion to enter into an intergovernmental agreement with West Baton Rouge Parish Council and Republic Services for renewal of the solid waste and recycling contract was made by Council Member Bourgeois; seconded by Council Member Neisler. Mayor Rhodes opened the floor for public comment. Hearing no comments, a roll call vote was had with the following results:

Consideration of Vetoed Ordinances: None

Hearing and Final Action on Ordinances:
Mayor Rhodes read aloud Ordinance 6 of 2019 to amend and re-enact the code of ordinances for the Town of Brusly, Section 17.15 to allow bicycles on sidewalks and opened the public hearing. Hearing no comments, Mayor Rhodes closed the public hearing and turned the matter over to the council. After determining that the Ordinance included wording to give pedestrians the right of way on all sidewalks and trail ways, a motion to approve was made by Council Member Daigle; seconded by Council Member Richard. Mayor Rhodes opened the floor for public comment. Hearing no comments, a roll call vote was had with the following results:

Introduction of Ordinances: None
Resolutions:
Upon the recommendation of Mayor Rhodes, a motion to authorize Mayor to sign an intergovernmental agreement with WBR Parish regarding garbage pickup, was made by Council Member André; seconded by Council Member Richard. Mayor Rhodes opened the floor for public comment. Hearing no comments, the motion passed unanimously.

At the request of Mayor Rhodes, a motion to form a Committee for the Trailhead Property which included Mayor Rhodes, Council Member Bourgeois, Council Member André, Brusly Citizen Anatole Vincent, Brusly Citizen Warren LeJeune and Cinclare Harry Laws Manager Drew Maciasz, was made by Council Member Richard; seconded by Council Member Bourgeois. Mayor Rhodes opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Police Department Report:
Police Department Report for the month of Aug. was given by Police Chief Lefeaux. There were four (4) alarms, two (2) warrant arrests, one (1) violation of protective order, five (5) civil complaints, ten (10) miscellaneous complaints, seven (7) disturbance calls, three (3) assist to other agencies, fifteen (15) no insurance tows, ten (10) crash reports, one (1) criminal damage to property, one (1) burglary, three (3) unlock calls, two (2) traffic complaints, one (1) illegal use of weapons, two (2) fire calls, one (1) theft, four (4) battery calls, one (1) medical, one (1) DWI, three (3) suspicious persons, one (1) hit and run, and one (1) missing person. For the month, there were 79 total complaints, 296 total citations and 386 total violations.

Mayor’s Report:
Mayor Rhodes reported that work was continuing on drainage throughout the Town and a report was being prepared by Public Works Director Shane Sarradet for the Council’s review.

Remarks of Personal Privilege:
Council Member Bourgeois stated that there will be a Veteran’s Day Breakfast held at the Town Hall on November 11, 2019, at 8:30 a.m..

Announcements:
Household Hazardous Waste Day is Saturday September 28th at Alexander Park from 8:00 AM to 12:00 PM.

A motion was made by Council Member André to adjourn; seconded by Council Member Richard. Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 6:48 PM.
