Town Meeting Minutes – November 2020

The regular meeting of the Town of Brusly was called to order this date, November 9, 2020, at the Brusly Town Hall, at 6:30 p.m.  Council Member André led the Pledge of Allegiance.    A roll call determined the following officials present:

Council Members:          Rusty Daigle, Joanne Bourgeois, Terry Richard, Shane André, Don Neisler
Town Attorney:              Thomas Acosta, Jr.
Absent:                             None

Recognitions & Commendations: None

A motion to approve the minutes of the Town’s regular meeting of October 12, 2020, as written, was made by Council Member Bourgeois and seconded by Council Member Richard.  Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed with a unanimous vote.

Public Works Committee:

Mayor Rhodes read the Public Works Report, as prepared by Public Works Supervisor Shane Sarradet, for the month of October. There were 3.6 inches of rainfall in the month; no drainage issues; 2 named storms in October with minor debris cleanup from both; 1 SCADA alarms; 0 “out of compliance” test result on the Sewer Treatment Facility; sidewalks throughout town were edged; flood bypass pump is fully operational after outfitting it with flanges and hoses; a draft of the LPDES permit has been issued for our review; no incidents to report for the Maintenance Department for the month of October.

Flags were put up Nov. 9th and will fly through Thanksgiving.  Christmas decorations install will begin the week after Thanksgiving.

Regular bulk trash will be picked up the week of Nov. 9, 2020.  The extra trash pickup will be Friday, November 27, 2020.

Mayor Rhodes presented three estimates for the Brusly Gateway Sign for LA1 at the North bound City Limit site, at the south Town entrance.  A motion to approve the lowest estimate from Cypress Graphics in the amount of $7,400, was made by Council Member Neisler; seconded by Council Member Daigle.  Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed with a unanimous vote.

Planning and Zoning Committee:

Mayor Rhodes read aloud the variance request of Charles Holmes at 3016 Orleans Qrts. for non-compliance of Sec. 19.31.1 Zoning District R-1 Side Setback, to reduce the setback from10’ to 4’ to build an accessory structure.  Having presented the original signed letter of no objection from the adjoining neighbor and having been unanimously recommended by the Planning & Zoning Commission, a motion to approve the variance was made by Council Member Richard; seconded by Council Member Daigle.   Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed with a unanimous vote.

Mayor Rhodes presented a cooperative endeavor agreement with West Baton Rouge Parish for permitting and inspections.   After discussion, a motion to table the issue until more information was available was made by Council Member André; seconded by Council Member Richard.  Mayor Rhodes opened the floor for public comment.  Mr. Joey Normand expressed concern regarding the Town’s loss of control of the building permit process.  Attorney Acosta explained the differences in the existing agreement between the Town and the Parish and the new proposed agreement.  At the conclusion of comments, a roll call vote was had with the following results:

The cooperative endeavor agreement with West Baton Rouge Parish for permitting and inspections was tabled.

Finance Committee:
Mayor Rhodes noted that the “Budget to Actual Comparison Report” for October was included in the meeting packets for Council Members to review.

Upon Mayor Rhodes recommendation, and a brief discussion, a motion to authorize the Mayor to sign an Occupational License Tax Program contract with AVENU, adding Beer/Liquor licenses to the existing contract, was made by Council Member Neisler; seconded by Council Member Daigle.  Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed with a unanimous vote.

Police Committee: None

Governmental Affairs Committee:

Mayor Rhodes announced that the Town had won 1st place in the LMA Community Achievement Awards for the Bike Share Program.

Upon the recommendation of Mayor Rhodes, a motion to reappoint Scarlet Callicoatte, Brian Falcon and Billy Hebert as Landmark & Heritage Commission Advisory Members for a 2-year  term was made by Council Member Bourgeois; seconded by Council Member Richard.  Mayor Rhodes opened the floor for public comments.  Hearing no comment, the motion passed unanimously.

Council Member Bourgeois described the home of C.G.Mouch, located at 600 Lee Drive, built in 1967, by Manuel Martin. The house was built on the first lot to be sold in 1964 in Courtney Subdivision by Mrs. Irma Tullier.  It was also noted that Mr. Mouch served as Brusly Volunteer Department Fire Chief in the 1980s.  Having been recommended by the Landmark & Heritage Commission to receive a Certified Landmark Plaque, a motion to approve was made by Council Member Bourgeois; seconded by Council member Neisler.  Mayor Rhodes opened the floor for public comments.  Hearing no comment, the motion passed unanimously.

Consideration of Vetoed Ordinances:  None

Hearing and Final Action on Ordinances:

Ordinance 5 of 2020, to adopt and enact a new Code of Ordinances for the Town of Brusly was read aloud and opened for Public Hearing by Mayor Rhodes.  Hearing no comments from the public, Mayor Rhodes directed the issue to the Council for consideration.    A motion to adopt Ordinance 5 of 2020, as discussed, was made by Council Member André; seconded by Council Member Bourgeois. A roll call vote was had with the following result:

Police Department Report:

Police Department Report for the month of October was given by Assistant Chief Southon.  There were fourteen (14) alarms, three (3) suspicious persons, twenty (20) truancy investigations, one (1) battery, eighteen (18) miscellaneous complaints, ten (10) disturbances, two (2) fires, twelve (12) no insurance tows, sixteen (16) crash reports,  one (1) medical, six (6) roadway hazards, one (1) cruelty to juvenile, two (2) drug related, two (2) thefts and twelve (12) public assists.  For the month, there were 120 total complaints, 218 total citations and 301 total violations.

Mayor’s Report: 

Mayor Rhodes congratulated the re-elected Council Members; André, Bourgeois, Daigle and Neisler.  Mayor Rhodes also thanked Council Member Richard, who did not seek another term, for his service during the past 2 terms.  The Mayor gave a brief update on the Levee Trailhead Park Project.

Announcements:

There will be no Veteran’s Day program at the Town Hall due to COVID-19.

A motion was made by Council Member Richard to adjourn; seconded by Council Member André.  Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 7:16 PM.
