The regular meeting of the Town of Brusly was held this date, May 11, 2009 at the Brusly Town Hall.

Council Member Olinde led the Pledge of Allegiance. A roll call determined the following officials present:
Council Members: Thomas Olinde, Joanne Bourgeois, Landess Hebert,
Shane Andre’,
Chris Kershaw
Town Attorney: Thomas Acosta, Jr.
Mayor: Joey Normand

Mayor Normand introduced Deano Moran, Director WBRP Office of Homeland Security. Mr. Moran gave a presentation on Hurricane Preparedness, outlining new procedures being put into place by the EOC.

A motion to approve the minutes of the Town’s Regular Meeting of April 13, 2009, with two minor typographical corrections, was made by Council Member André and seconded by Council Member Olinde. The motion passed with a unanimous vote.
A motion to approve the minutes of the Town’s Special Meeting of April 20, 2009 was made by Council Member Bourgeois and seconded by Council Member Olinde. The motion passed with a unanimous vote.

Public Works Committee:
Upon Mayor Normand’s request, a motion to authorize the Mayor to sign the DOTD contract to cut grass in the median was made by Council Member André; seconded by Council Member Hebert. The motion passed unanimously.

Planning and Zoning:
After some discussion, a motion to approve a variance on road frontage from 80 feet to 75 feet for two of the six lots for the subdivision of the Joel P. Tingle property located at 1527 Allene Street, described as 2.58 acres less 0.46 acre, Section 56, T8S, R12E for Joel Tingle, was made by Council Member Hebert; seconded by Council Member André. A roll call vote was had with the following results:
Yeas: Bourgeois, Hebert, Kershaw, Olinde, André
Nays: None
Absent: None
The motion passed.

A motion to approve the subdivision plat of the Joel P. Tingle property located at 1527 Allene Street, described as 2.58 acres less 0.46 acre, Section 56, T8S, R12E for Joel Tingle, with the stipulation that no driveway will be allowed to connect to Pecan Street, was made by Council Member Kershaw; seconded by Council Member André. A roll call vote was had with the following results:
Yeas: Hebert, Kershaw, Olinde, André, Bourgeois
Nays: None
Absent: None
The motion passed.

A motion to accept the recommendation of the Planning and Zoning Commission to grant a variance request submitted by Daniel R. Scott, 467 Marionneaux Street, Lot # 40A, Southside Acres Subdivision, requesting a side setback variance of nine (9) Feet on the East side of his property was made by Council Member Kershaw; seconded by Council Member André. A roll call vote was had with the following results:
Yeas: Kershaw, André
Nays: Olinde, Bourgeois, Hebert
Absent: None
The motion failed.

A motion to grant a variance request submitted by Jonathan and Paula Bernard to construct a fence on the drainage servitude on the rear of their property at 408 Gleason Street was made by Council Member Hebert; seconded by Council Member Olinde. A roll call vote was had with the following results:

Absent: None

Finance Committee:
Mayor Normand presented the 2009-2010 General Fund and Sewer Budget Messages, in writing, to Council Members. The Budget will be discussed at the June 1st Committee Meeting.

Personnel Committee: None

Recreation Committee:
Council Member Bourgeois announced that the Landmark and Heritage Committee recommended the following properties to receive Town of Brusly Landmark Plaques:

A motion to approve the Landmark Plaque recipients was made by Council Member Bourgeois; seconded by Council Member Kershaw. The motion passed unanimously.

Police Committee:
Mayor Normand recommended the appointment of Chief Jamie Whaley to the Committee for Animal Control Ordinance. Council Member Bourgeois motioned to approve; seconded by Council Member Hebert. The motion passed unanimously.

Acting on behalf of Police Chief Whaley, Richard Johnson recommended hiring Gary Green at $12.50 hour with the starting date being upon completion of his two week notice to his present job. A motion to accept the recommendation was made by Council Member Bourgeois; seconded by Council Member André. A roll call vote was had with the following result:

Government Affairs Committee:
Mayor Normand recommended the appointment of Council Member André to the WBR Community Advancement Advisory Board. Council Member Kershaw motioned to approve; seconded by Council Member Hebert. The motion passed unanimously.

Council Member Bourgeois announced that 360 Landmark books totaling $4,692.00 had been sold thus far. Council Member Bourgeois announced that the Town of Brusly had received Tree City Certification for 2008, for the fifth year in a row. She further announced the Town won first place in the Cleanest City contest, District VI , Category B. Council Member Bourgeois recognized Shelbi Graft, Joy Jason and Elizabeth Wallace for their participation in the Cleanest City Essay Contest, stating they will be receive certificates of recognition at next month’s Council Meeting. Council Member Bourgeois also stated that there would be an Arbor Day Ceremony at Brusly Middle School on May 14, 2009 at 10:30 a.m.

Hearing and Final Action on Ordinances: None

Introduction of Ordinances:
Council Member Bourgeois introduced an Ordinance for the 2008-2009 Town Budget adjustments. Council Member André introduced an Ordinance for the 2009-2010 General Fund Budget. Council Member André introduced an Ordinance for the 2009-2010 Sewer System Budget.

Resolutions and Commendations:
Resolution #5 of 2009 to recognize and designate the third full week of September in each year as Mitochondrial Disease Awareness Week was accepted unanimously upon a motion by Council Member Bourgeois with a second by Council Member Olinde.

Fire Department:
Fire Chief Alleman gave the Fire Chief’s report for April. There were twelve (12) first aid calls inside the Town and one (1) outside of Town. There were no fire calls inside or outside the Town. There was one (1) false alarm investigation. There were three (3) trash fires and two (2) motor vehicle fires. There were four (4) motor vehicle crashes and two (2) mutual aid calls. The total calls for the month were thirty seven (25). Total calls year to date are one hundred twelve (112).
Chief Alleman also announced that the Fire Department still has reflective house number signs at the cost of $10.00 each.

Police Department:
Report for the month of April was given by Richard Johnson. There were three (3) wrecks, eight (8) bench warrant arrests, two (2) damage to property, one (1) disturbing the peace, two (2) theft, one (1) burglary, five (5) alarms, ten (10) Asst. to other agencies, one (1) juvenile matter, six (6) traffic arrests and twenty three (23) miscellaneous calls. There were a total of 62 calls, 125 citations and 171 violations.
There were twelve (12) bench warrants collected by phone calls.

Mayor’s Report:
Mayor Normand announced that the Main Street railroad crossing would not be fixed until after July 1st due to DOTD budget restrictions. The Mayor, Councilmembers Kershaw and Bourgeois participated in the Great American Clean Up on April 25th. The Mayor was one of five Mayors to represent the LMA at a Public Affairs Research Meeting. Mayor Normand attended a Junior Achievement luncheon in Plaquemine and the opening of a WBR Parish Museum exhibit. The Mayor announced that the Town of Brusly has received its Hurricane Gustav reimbursement from FEMA. Mayor Normand received a thank you note from WBRP Parks and Recreation for sponsoring a bitty basketball team.

Remarks of Personal Privilege:
Darrell Jones thanked the Police and Fire Chiefs for their departments’ quick response to an alarm at his home while he was out of town. Fire Chief Alleman thanked the Council, Mayor and Debbie Berthelot for their work and support on the 2009-2010 Budget. Council Member Bourgeois expressed gratitude to Firefighter Brett Cavaliere who will be leaving for active duty in Afghanistan at the end of May. Rosa Stelly thanked the Police Department and Town Council for their work on clearing up the Nuisance Ordinance violations around town.

A motion was made by Council Member André to adjourn; seconded by Council Member Olinde. The motion passed with a unanimous vote. The meeting adjourned at 7:31 p.m.
