The regular meeting of the Town of Brusly was held this date, January 14, 2013 at the Brusly Town Hall.
Council Member Bourgeois led the Pledge of Allegiance. A roll call determined the following officials present:

Mayor: Joey Normand
Council Members: Scot Rhodes, Joanne Bourgeois, Terry Richard, Shane André,
Don Neisler
Town Attorney: William Klienpeter (Substituting for Tom Acosta)
Absent: None

Mayor Normand introduced Mr. Lance Crappell of Wright, Moore, DeHart, Dupuis & Hutchinson, Inc.
Mr. Crappell presented the 2011/2012 Audit Report for the Town of Brusly. Mr. Crappell reported that the audit was overall a very clean report with a couple minor compliance violations. A motion to accept the 2011/2012 audit report was made by Council Member Bourgeois; seconded by Council Member Neisler. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

A motion to approve the minutes of the Town’s regular meeting of December 10, 2012, was made by Council Member André and seconded by Council Member Rhodes. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Public Works Committee:
Upon Mayor Normand’s recommendation a motion to accept the Barber Brothers Contract Company, Inc. street overlay low bid of $74,950.00, was made by Council Member Bourgeois; seconded by Council Member Richard.
Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Upon Mayor Normand’s recommendation a motion to increase the scope of the street overlay project to include an additional $12,296.00 for patching on three additional streets, was made by Council Member Neisler; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comment. Hearing no comments, the motion passed with a unanimous vote.

Planning and Zoning Committee:
Mayor Normand read aloud the Variance Request for: Margaret Allain – 3349 Live Oak Dr. – Reduce minimum side yard from 10 Feet to 6 Feet (See Re-subdivision of Lot 73 into Lots 73-A, 73-B & 73-C submitted for approval) and turned the meeting over to Mayor Pro Tempore Bourgeois, stating that one of the properties involved belonged to his wife. Mayor Pro Tempore Bourgeois opened the floor to entertain any motions on the variance request which the Planning & Zoning Commission has favorably recommended. A motion to grant was made by Council Member Rhodes; seconded by Council Member Neisler. Mayor Pro-tempore Bourgeois opened the floor for public comment. Hearing no comments a roll call vote was had with the following results:

Mayor Pro Tempore Bourgeois presented the Final Plat Showing the Re-subdivision of Lot 73 into Lots 73-A, 73-B, 73-C & the Exchange of Property between Lots 73 & 74 – 3349 Live Oak Dr. for Margaret Allain, which has been favorably recommended by the Planning & Zoning Commission. A motion to approve the re-subdivision was made by Council Member André; seconded by Council Member Rhodes. Mayor Pro-tempore Bourgeois opened the floor for public comment. Hearing no comments a roll call vote was had with the following results:

Mayor Pro Tempore Bourgeois presented the Final Plat Showing the Re-subdivision of Lot 74 into Lots 74-A, 74-B & the exchange of Property between Lots 73 & 74 – 3419 Live Oak Dr. for Andrea Saucier, which has been favorably recommended by the Planning & Zoning Commission. A motion to approve the re-subdivision was made by Council Member Rhodes; seconded by Council Member Neisler. Mayor Pro-tempore Bourgeois opened the floor for public comment. Hearing no comments a roll call vote was had with the following results:

Mayor Pro Tempore Bourgeois turned the meeting back over to Mayor Normand at which time he presented the Final Plat Showing Subdivision of Lot “A” and a called 85’ X 225’ Lot of the Original Mrs. Ida LeRay Property and a called 50’ X 225’ Lot of the Original Edward C. Carter Property into Lots A-1 & A-2 – 350 N. LaBauve Ave. for Todd Anthony LeRay, which has been favorably recommended by the Planning & Zoning Commission. A motion to approve the re-subdivision was made by Council Member Rhodes; seconded by Council Member Neisler. Mayor Normand opened the floor for public comment. Hearing no comments a roll call vote was had with the following results:

Finance Committee:
Upon Mayor Normand’s recommendation, a motion to set the minimum value for the surplus Crown Victoria at $750.00, was made by Council Member André; seconded by Council Member Richard. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Personnel Committee:
Upon Mayor Normand’s recommendation a motion to appoint Council Member Rhodes as Mayor Pro Tempore was made by Council Member Bourgeois; seconded by Council Member André. Mayor Normand opened the floor for public comment. Hearing no comments a roll call vote was had with the following results:

Upon Mayor Normand’s recommendation a motion to appoint Council Member Richard to the Board of Adjustments was made by Council Member André; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Upon Mayor Normand’s recommendation a motion to appoint Council Member Rhodes to the Board of Adjustments was made by Council Member André; seconded by Council Member Bourgeois. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Upon Mayor Normand’s recommendation a motion to appoint Debbie Berthelot as Town Clerk was made by Council Member Bourgeois; seconded by Council Member Neisler. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Upon Mayor Normand’s recommendation a motion to appoint Tom Acosta as Town Attorney was made by Council Member Bourgeois; seconded by Council Member Rhodes. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Council Member André made the motion to approve the list as presented; seconded by Council Member Neisler. Mayor Normand opened the floor for public comments. Hearing no comments the motion passed unanimously.

Governmental Affair Committee:
Council Member Bourgeois spoke about the Arbor Day Ceremony that took place on December 12th of 2012.

Consideration of Vetoed Ordinances: None

Hearing and Final Action on Ordinances:
Mayor Normand read aloud Ordinance #11 of 2012, to amend and re-enact the Code of Ordinances of the Town of Brusly, Louisiana, Chapter 4-Personnel, relative to section 4.2 Employment Classifications for Permanent Part-Time Employees. Mayor Normand opened the public hearing. Hearing no comments a roll call vote was had with the following results:

Introduction of Ordinances:
Council Member André introduced an Ordinance for 2012/2013 Town budget adjustments.

Resolutions and Commendations: None

Fire Department Report:
Fire Chief Alleman gave the Fire Chief’s report for December. There were ten (10) first aid calls inside the Town, seventeen (17) outside of Town and six (6) public assistance calls. There were no fires inside or outside of Town. There were three (3) odor investigations and one (1) grass fire. There were three (3) motor vehicle crashes and three (3) mutual aid calls. The total calls for the month were forty-four (44). The total for the year is four hundred six (406).

Police Department Report:
Report for the month of December was given by Sgt. Robertson. There were six (6) wrecks, eight (8) bench warrant arrests, one (1) damage to property, one (1) burglary, two (2) alarms, two (2) assist to other agencies, one (1) juvenile matter, six (6) traffic arrests and eight (8) miscellaneous calls. For the month’s total, there were 35 calls, 135 citations and 176 violations.

Mayor’s Report:
Mayor Normand gave a brief update on the new Police Station project. The Mayor attended the Parish Council Meeting, reporting that the new Allied Waste contract was signed for lower rates than the previous contract. Mayor Normand thanked Debbie Berthelot and the staff for putting together the Swearing In Ceremony which went well. The Mayor reported the heavy rainfall did not cause any problems with the drainage ditches but that the sewer ponds were filled to the maximum. Mayor Normand expressed enjoyment at having the Town Hall visited by the Mrs. Jones, the Special Education Teacher for Brusly Middle, along with five of her students.

Remarks of Personal Privilege:
Parish Council Member Kershaw gave a brief update on issues being discussed by the Parish Council.

Announcements:
The Town Hall will be closed Monday, January 21st in observance of Civil Rights Day.
There will be a Landmark & Heritage Meeting January 28th at 6:30 PM in the Town Hall Chambers.
The Town Hall will be closed Tuesday, February 12th in observance of Mardi Gras.

A motion was made by Council Member André to adjourn; seconded by Council Member Rhodes. The motion passed with a unanimous vote. The meeting adjourned at 7:21 PM.
