Town Meeting Minutes – May 2018

The regular meeting of the Town of Brusly was held this date, May 14, 2018, at the Brusly Town Hall, at 6:30 p.m. Council Member Bourgeois led the Pledge of Allegiance.  A roll call determined the following officials present:

Mayor:                         Scot Rhodes
Council Members:      Rusty Daigle, Joanne Bourgeois, Terry Richard, Shane Andrè, Don Neisler
Town Attorney:          Thomas Acosta, Jr.
Absent:                       None

Upon the request of Mayor Rhodes, a motion to amend the agenda to add 5.G.b. Landmark Plaques, was made by Council Member Bourgeois; seconded by Council Member Richard.

Mayor Rhodes opened the floor for public comments. Hearing no comments, a roll call vote was had with the following results:
Yeas:               Bourgeois, Daigle, Richard, Andrè, Neisler
Nays:               None
Absent:           None

A motion to approve the minutes of the Town’s regular meeting of April 9, 2018, as presented, was made by Council Member Andrè and seconded by Council Member Neisler.  Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed with a unanimous vote.

Finance Committee:
Mayor Rhodes referred to the “Budget to Actual Comparison Report,” included in the meeting packets, for Council Members to review.

Mayor Rhodes presented his 2018/2019 Town & Sewer Budget messages to Council Members.
Public Works Committee:

Mayor Rhodes reported that the project to replace the culvert near the end of Gleason Street    had been completed.
Planning and Zoning Committee:

Mayor Rhodes presented the Marionneaux Development plans to the Council for consideration. Mr. Court Bradford, representing developer Scott Thomas, explained the proposed preliminary plat showing the subdivision of Lot SSA-1-A-1 (2.323 Acres) South Side Acres Subdivision, Second Filing Part 1 into Lots SSA-1-A-1-A, SSA-1-A-1-B, SSA-1-A-1-C, SSA-1-A-1-D, SSA-1-A-1-E, and SSA-1-A-1-F Located in Sec. 17, T8S – R12E Town of Brusly West Baton Rouge Parish Southeastern Land District West Baton Rouge Parish for Scott Thomas to the Council and offered to answer any questions posed.  After a brief discussion, Council Member Andrè offered a motion to approve the preliminary plat with the servitude and name changes discussed; seconded by Council Member Neisler.  Mayor Rhodes opened the floor for public comments.  Hearing no comments, a roll call vote was had with the following results:

Mayor Rhodes read aloud a Variance Request for Non-Compliance – Sec. 19.6-Servitude Encroachment, for a fence construction by Cody Devillier, 2832 Orleans Quarter. A motion to approve was made by Council Member Bourgeois; seconded by Council Member Richard. Mayor Rhodes opened the floor for public comments.  Hearing no comments, the motion passed unanimously.

Personnel Committee:
Mayor Rhodes reported Public Works Director Shane Sarradet hired Darren Badeaux as a Part-Time Temporary Employee. This hire may possibly become designated Permanent Full-Time.

Recreation Committee:
Mayor Rhodes updated progress on the St. Francis Street Sidewalk project.

Police Committee:  None

Governmental Affairs Committee:
A motion to appoint the West Side Journal as the Official Journal of the Town was made by Council Member Richard; seconded by Council Member Daigle. Mayor Rhodes opened the floor for public comment.  Hearing no comment, the motion passed unanimously.

Council Member Bourgeois presented the following homes which were recommended by the Landmark & Heritage Commission as recipients of a Certified Landmark Plaque.

229 Hebert St. – Ricky Tullier
238 Hebert St. – Charlotte & Chris Carpenter
257 Hebert St. – Patricia Cheek
120 Hebert St. – Patrick Allain

A motion to approve the proposed homes to receive Landmark Plaques was made by Council Member Bourgeois; seconded by Council Member Andrè. Mayor Rhodes opened the floor for public comment.  Hearing no comments, the motion passed unanimously.

Consideration of Vetoed Ordinances:  None

Hearing and Final Action on Ordinances:
Ordinance 3 of 2018, to amend the appropriations ordinance of 2017-2018; to provide relative to appropriations for the income and expenses of the Town was read aloud and opened for Public Hearing by Mayor Rhodes. Hearing no comments from the public, Mayor Rhodes directed the issue to the Council for consideration.   A motion to adopt Ordinance 3 of 2018, as discussed, was made by Council Member Neisler; seconded by Council Member Bourgeois. A roll call vote was had with the following result:

Absent:            None

Ordinance 4 of 2018, to amend the appropriations ordinance of 2017-2018; to provide relative to appropriations for the income and expenses of the Sewer was read aloud and opened for Public Hearing by Mayor Rhodes. Hearing no comments from the public, Mayor Rhodes directed the issue to the Council for consideration.   A motion to adopt Ordinance 4 of 2018, as discussed, was made by Council Member Andrè; seconded by Council Member Richard. A roll call vote was had with the following result:

Absent:            None

Introduction of Ordinances:
Council Member Andrè introduced Ordinance 6 of 2018- General Funds 2018/2019 Budget.
Council Member Neisler introduced Ordinance 7 of 2018-Sewer 2018/2019 Budget.

Resolutions and Commendations:
Mayor Rhodes read aloud Resolution 3 of 2018. A motion to Discontinue Collection of Ad Valorem Taxes for the Year 2018, for the Town of Brusly, was made by Council Member Bourgeois; seconded by Council Member Richard. Mayor Rhodes opened the floor for public comment. Hearing no comment, the motion passed unanimously.

Resolution 4 of 2018, to Appoint Baxley & Associates LLC for 2017/2018 Fiscal Year Audit, was recommended by Mayor Rhodes. A motion to approve was made by Council Member Bourgeois; seconded by Council Member Andrè.  The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Resolution 5 of 2018, to declare a 2013 Chevy Tahoe surplus for disposal and to set minimum price for sale at public auction, was recommended by Mayor Rhodes. A motion to approve was made by Council Member Richard; seconded by Council Member Neisler.  The Mayor opened the floor for public comment. Hearing no comments, the motion passed unanimously.

Police Department Report:
Police Department Report for the month of April was given by Chief Jonathan Lefeaux. There were seven (7) alarms, eight (8) warrant arrests, three (3) assists to other agencies, nine (9) civil complaints, thirteen (13) miscellaneous complaints, seven (7) disturbance calls, two (2) public assists,  seventeen (17) no insurance tows,  four (4) crash reports, three (3) suspicious person/vehicle calls, two (2) medical, three (3) unlock calls, three (3) traffic complaints, one (1) battery, one (1) harassing phone call, one (1) animal cruelty, four (4) thefts, three (3) criminal damage to property, one (1) missing person  and one (1) drug arrest.  For the month, there were 93 total complaints, 292 total citations and 425 total violations.

Mayor’s Report:  
Mayor Rhodes reported that Town employee Patricia Gaudet Thibodaux was mentioned in the LMA Municipal Review for being elected as Vice-President of the Louisiana Association of Municipal Secretaries & Assistants. Mayor Rhodes also reported that the Splash Pads at Alexander Park will be turned off at 7:00 PM daily due to concerns about low water at certain times of the day in our area.

Remarks of Personal Privilege:
Parish Council Member Kershaw gave a brief update on WBR Parish projects.

Council Member Andrè remarked that he was not satisfied with the progress being made on solving the problem that resulted in the Town having an $80,600 budget adjustment for filing an insurance claim. Council Member Andrè suggested that the Town contact the Legislative Auditor and/or the FBI to resolve the issue and make an arrest.

Announcements:
The Town Hall will be closed Monday, May 28th for Memorial Day.
There will be a Landmark Plaque Presentation Ceremony Sunday, June 10th at 3:00 PM at the Town Hall.

A motion was made by Council Member Richard to adjourn; seconded by Council Member Andrè. Hearing no comments, the motion passed with a unanimous vote. The meeting adjourned at 7:16 PM.
